Exemption from Arrest of Yediyurappa Due to Former Chief Minister Status is a Mockery of Law: Shahnawaz Alam

Minority Congress State President Shahnawaz Alam has termed the exemption from arrest granted to senior Karnataka BJP leader BS Yediyurappa by Karnataka High Court Judge S Krishna Dixit, in a POCSO case, due to his status as a former Chief Minister, as a mockery of the law. He alleged that under the BJP government, the principle of equality before the law has ceased to exist.

In a press release issued from the Congress headquarters, Shahnawaz Alam stated that in recent years, there have been increasing examples of selective judgments by judges in cases involving politicians. He questioned how it is possible that opposition party Chief Ministers like Hemant Soren and Arvind Kejriwal are sent to jail even for minor criminal charges, while a BJP leader accused of serious allegations like the sexual exploitation of a minor girl is exempted from arrest due to his former Chief Minister status. He noted that in the past, a Bareilly district judge had referred to Chief Minister Yogi Adityanath as a ‘philosopher king’ in a case ruling.

Shahnawaz Alam called on D.Y. Chandrachud, who is trying to build an image as a conscientious Chief Justice in the media, to clarify his position on this issue. He questioned whether, under his tenure as Chief Justice, the principle of equality before the law has been abandoned and if only opposition leaders would be sent to jail.

He stated that a perception is growing among citizens that the judiciary lacks the courage to take action against any senior BJP leader, no matter how serious the charges. He also remarked that on ideological agendas of the RSS, such as Article 370, CAA-NRC, Uniform Civil Code, the Places of Worship Act 1991, the role of Governors, or state-sponsored violence in Manipur, the courts are increasingly bowing to the government. This growing perception among the public is detrimental to democracy.
