Following the incident, a security guard, Anoop Kumar, filed a complaint at the Sector 126 police station. In a statement, Noida Police said, “A video has gone viral on social media in which a woman can be seen misbehaving with a security guard at Jaypee Greens Wishtown, which comes under Sector 126 police station. Noida police took note of the video and Sector 126 police registered a case against the woman (Bhaavya Rai) under IPC section 153A (promoting enmity between different groups on the basis of religion, race, place of birth, residence, language etc. conduct prejudicial to maintaining harmony), 323 (causing hurt), 504 (intentional insult with intent to cause a breach of the peace), 505 (2) (statements inciting enmity, enmity or ill-will between classes) and 506 (criminal intimidation). In his complaint, Anoop Kumar said the incident took place around 5.45 pm. The complainant stated that he was on duty when Roy arrived in her car. He claimed she started abusing him when he got up to open the gate. “She assaulted me in front of everyone, humiliated me and threatened to kill me,” the guard said in the complaint. “I and my fellow guards tried many times to stop her but she did not listen and continued to insult her and even used insults and slurs for a particular community,” he further said, according to the complaint.
After the incident, the woman arrived at the police station in her own car. Images from her building show her driving a car with police officers sitting inside. “We asked her to come in for questioning. She came in her car. The police escorted her…” said a senior police officer.
According to the Residents Welfare Association, Rai has been living in the building since May. Anshu Gupta, treasurer of RWA said, “We don’t know much about the woman as she has been living here for three months…. he is a tenant. According to our information, the exit gate is towards Pavilon Court, where all the guards write down the car registration plates. At the time of the incident, officers were recording the number of the car while the woman was also trying to escape. There was a delay of a few seconds… the woman started honking and later cursing… The guard was crying when we saw him today. He is in shock and spent half the day giving statements to the police.”
